Appeal against Suu Kyi’s Detention Handed in at Naypyidaw ေဒၚစု လြတ္ေျမာက္ေရး ေနျပည္ေတာ္မွာ အယူခံတင္
Suu Kyi’s lawyer, Kyi Win, told The Irrawaddy on Thursday that the appeal had been handed in personally by his assistant, Hla Myo Myint.
The government had given no indication when the appeal would be heard in court, Kyi Win said. “But we are hoping for a positive outcome.”
Suu Kyi’s latest five-year term of house arrest was extended in May for a further year—illegally, according to Kyi Win, because article 10 (b) of the Burmese State Protection Law 1975 stipulates that a person judged to be a “threat to the sovereignty and security of the State and the peace of the people” can only be detained for up to five years.
Suu Kyi has spent more than 13 years of the past 19 years confined to her Rangoon home.
Kyi Win said he planned to meet Suu Kyi soon to discuss the appeal.
Suu Kyi has reportedly been in poor health recently. She refused for about one month to accept deliveries of food and other household supplies at her home in what was seen as a protest against her continuing house arrest. Last week, she was visited by an eye specialist, Dr Kan Nyunt, and her personal physician, Dr Tin Myo Win.
At a Geneva press conference earlier this month, a UN High Commissioner for Human Rights official, Navanethem Pillay, expressed concern about Suu Kyi’s continuing detention and urged the regime to free her and all other political prisoners.
Suu Kyi had “in fact served a sentence that far exceeds that served by many hardened criminals,” Pillay said.
Pillay welcomed the recent release of seven political prisoners, but said it was a very small step when more than 2,000 political activists were still detained. “I urge the government to release them all as soon as possible,” she said.

“အယူခံလႊာကေတာ့ က်ေနာ့္ လက္တြဲဖက္ ေရွ႕ေနဦးလွမ်ိဳးျမင့္က ေနျပည္ေတာ္မွာ ဒီေန႔ မနက္က တင္လိုက္ပါၿပီ၊ အစိုးရ အဖြဲ႔ကလည္း လက္ခံထားလိုက္ၿပီ၊ ေနာက္တခါ ဒီဘက္က ျပည္ထဲေရးဗဟုိအဖြဲ႔ ဆိုတာ ရွိတယ္၊ တရားၿပိဳင္ေပါ့၊ သူတို႔က လည္း လက္ခံထားလိုက္တယ္၊ ေလွ်ာက္လႊဲခ်က္ ဘယ္ေန႔ေပးရမလဲ ဆိုတာ ရက္စြဲေတာ့ မေပးေသးဘူး”ဟု ဦးၾကည္၀င္းက ဧရာ၀တီသို႔ ေျပာသည္။
အဆိုပါအယူခံလႊာသည္ ျပည့္ျပည့္စုံစုံပါရွိသည့္အတြက္ စိတ္ေက်နပ္မႈရွိေၾကာင္း၊ အယူခံလႊာႏွင့္ ပတ္သက္ ၍ျဖစ္ေပၚလာ မည့္ အက်ိဳးသက္ေရာက္မႈ အေသးစိတ္ကို ေျဖဆိုျခင္းမျပဳ ေသာ္လည္း အယူခံလႊာအား အတည္ျပဳရန္ ေမွ်ာ္လင့္ထား ေၾကာင္း၊ ေဒၚေအာင္ဆန္းစုၾကည္ႏွင့္ ထပ္မံ၍ေတြ႕ဆုံႏိုင္ရန္အတြက္ လာမည့္ ေသာၾကာေန႔တြင္ အာဏာပိုင္မ်ားထံ စာေရး၍ ခြင့္ေတာင္းရန္ရွိေၾကာင္းလည္း ၎က ေျပာဆိုသည္။
၎အယူခံလြာႏွင့္ပတ္သက္၍ ယခင္က ေရွ႕ေနႀကီးမ်ားျဖစ္ၾကေသာ ဦးၾကည္၀င္း၊ ဦးဥာဏ္၀င္း၊ ဦးလွမ်ိဳးျမင့္ တို႔က လိုက္ပါေဆာင္ရြက္ရန္ စီစဥ္ထားေသာ္လည္း စစ္အစိုးရက တားျမစ္သည့္အတြက္ ဦးဥာဏ္၀င္းမွာ လိုက္ပါ ေဆာင္ရြက္ႏိုင္ ျခင္းမရွိေတာ့ေၾကာင္း သိရသည္။
“အခုအမႈမွာ ဦးဥာဏ္၀င္းက ပါ၀င္ေဆာင္ရြက္ႏိုင္ျခင္း မရွိေတာ့ဘူး၊ သူက အန္အယ္လ္ဒီ ပါတီ၀င္ျဖစ္ေနတယ္၊ တားဆီးမိန္႔ ၁၀(ခ)မွာ တခုပါတာက သံရုံးကပုဂၢိဳလ္ေတြ၊ ပါတီကပုဂၢိဳလ္ေတြနဲ႔ ဆက္သြယ္မႈမရွိရဘူး၊ အဲဒီအတြက္ အားေလ်ာ့သြား တာေပါ့”ဟုလည္း ဦးၾကည္၀င္းက ဆက္လက္ေျပာဆိုသည္။
ထိုေၾကာင့္ ေဒၚေအာင္ဆန္းစုၾကည္၏ ေနအိမ္အက်ယ္ခ်ဳပ္ႏွင့္ ပတ္သက္၍ ဥပေဒေၾကာင္းရ အယူခံ၀င္ ရန္အတြက္ ဦးၾကည္၀င္းႏွင့္ လက္ေထာက္ ေရွ႕ေန ဦးလွမ်ိဳးျမင့္တို႔ ၂ ဦးကသာ ဆက္လက္ တာ၀န္ယူ ေဆာင္ရြက္သြား ၾကမည္ျဖစ္သည္။

On the 22nd, with the request of Mr. Gambari who wanted to try again for the appointment, two members of Mr. Gambari, Mr. Erwan Pouchous and Ms. Hua Jiang together with U Soe Win, Deputy Director-General of the Ministry of Foreign Affairs and Police Col. Win Naing Tun of Myanmar Police Force visited Daw Aung San Su Kyi's residence, at 07:50 hrs. They tried to make contact by repeatedly informing the visit of two members of Mr. Gambari in front of her residence gate from 08:00 to 08:25 hrs. But there was no response. Despite Mr. Gambari's second attempt, he therefore didn't have a chance to meet Daw Aung San Su Kyi. Who told that Daw Aung San Su Kyi (DASSK) refused to see or accept Mr. Gambari? So far, only the official source of the spdc has released the information.
Who arranged the meeting for DASSK and Mr. Gambari? Only the assigned personnel with permission of the spdc members.
Who can grant permission to go inside the compound of DASSK’s residence to see her? Only the assigned personnel allowed by the spdc members can; without their permission one who dares to do is automatically designated as a betrayer.
DASSK is a detained person under heavy security, surveillance and guards. She cannot do anything as she wishes because she has been imprisoned under house arrest. The chance to meet, to talk and deal with DASSK is manipulated only by the very high authorities with permission of the spdc members. The residence is really owned by DASSK’s family but under the surrogated guardian – spdc, the national kidnappers; without their permission nothing can be dealt for the national hostage – DASSK.
Is it the proper and decent dealing with the respectful national and Asian heroine by calling out by the backyard gate using the speaker from outside? It is no need for the concerned persons to call out DASSK from the gate to deliver the letter or information as they can get proper permission from the very high authorities for reaching DASSK personally according to the proper procedure. It is not necessary for the concerned persons to stick the letter at the gate; if they have the strong will the letter can be reached to DASSK by the proper mean with the grant of the higher authorities. However, the spdc members deliberately and intentionally want to create the situation as such for propaganda of that DASSK is ignoring the request of Mr. Gambari and undermining the prestige of the UN special envoy. DASSK can do nothing without permission except sitting and waiting to be contacted as the detained hostage.
Here the following queries are raised and have to be judged for answers.
Did DASSK actually know the meeting with Mr. Gambari? (Who can guarantee that DASSK got the prior notification for the meeting with Mr. Gambari)
Had DASSK been well informed for the prepared meeting? (How can we know whether the authorities honestly and officially notify DASSK for meeting with the special UN envoy or not)
Did the authorities really arrange to take DASSK for the meeting with Mr. Gambari? (Just for show jobs, the authorities may send a vehicle with official/s to DASSK’s residence for transport with the instruction not to contact anyone including DASSK just entering and waiting; so how did DASSK know the vehicle is for what purpose; after some hours the vehicle got out of the compound without DASSK as instructed}
Did DASSK really refuse to meet the UN special envoy? ( Only DASSK can give the correct answer )
Is there any eyewitness to testify that DASSK has voluntarily turned down the appointment? ( very doubtful )
Is there any record of verbal or written evidence for DASSK’s refusal? ( If the concerned authorities are sincere they will make record for evidence )
Was DASSK given the letter of Gambari? (How can we prove whether the letter was given to DASSK)
If the answers are ‘NO’, the other side of the refusal of DASSK will be assessed with common sense. The right answers can be released by only one person – the national hostage.
The information for the refusal of DASSK to meet Mr. Gambari will reflect the consequences –

The information has been manipulated by the spdc’s members performing psychological operation with PSY-OP2008 neo-virus to defame DASSK, to destroy the image of the NLD, to get the upper hand in the political atmosphere of Burma, to lure UN, Asean and regional countries for supporting their road map.
The spdc’s leader Than Shwe is the champion of the psychological operation as career and the Liaison minister Aung Kyi is the master of brain-wash program for military personnel.
The spdc has tried for assassination of DASSK and NLD leaders at the corner near her compound in November 11, 1996, and in the Deparin crisis in May 30, 2003. Those are the assassination of life of the Burmese charisma. Now the spdc has plotted the assassination of fame, prestige and dignity of the Nobel peace laureate.
In accordance with the recent development of the mission of the UN and the special envoy everyone can wisely comment that Mr. Gambri et al squeeze milk from the horn. UN and Mr. Gambari has been fallen in the SPDC’s trap.

Thai Protest Leaders Agree to Surrender

BANGKOK — Leaders of Thailand's anti-government protests said Thursday they will surrender to police after a court dropped treason charges against them, but vowed to continue their sit-in at the prime minister's office.
Hundreds of black-clad doctors and nurses, meanwhile, marched to the national police headquarters in Bangkok, demanding that the government step down to take responsibility for clashes between police and protesters two days earlier in which two people were killed and more than 443 were injured, including 20 police.

Arrest warrants were issued for the alliance's nine leaders August 27, the day after they led thousands of protesters onto the grounds of Government House. They have occupied the complex since then, demanding the resignation of leaders linked to former Prime Minister Thaksin Shinawatra, who was ousted in a 2006 military coup for alleged corruption and misuse of power.
The Appeals Court on Thursday revoked three of the five charges on the warrants—treason, stockpiling of weapons and refusing to disperse. It said it would issue new warrants with the two remaining charges of inciting a public disturbance and illegal assembly, which carry prison terms of seven and three years respectively.
Protest leaders had said they were willing to fight the charges, except treason, which carries a possible death sentence and that they deemed unjustified.
"We have never accepted the charges of insurrection and stockpiling of weapons in the first place so I am grateful that the court revoked them," Sondhi told protesters from a stage on the Government House lawn. "We will report to the police for the rest of the charges."
"But we will not leave Government House until they come to disperse us," he said to loud cheers.
Two of the nine protest leaders—Chamlong Srimuang and Chaiwat Sinsuwongse—were arrested recently after leaving the grounds of the compound. The Criminal Court said Thursday they would be released and waived bail of 100,000 baht (US $2,900) when a senator agreed to act as their guarantor. The others had escaped arrest by refusing to leave Government House.
The prime minister and his Cabinet have been forced to operate temporarily out of Bangkok's old airport.
The development came two days after the protesters clashed with riot police in the worst political violence in Thailand in more than a decade.
Both sides have accused the other of using excessive force.
Some protesters had their limbs or feet blown off, but police insist they only used tear gas and that some demonstrators may have been hurt by explosives they themselves were carrying. AP reporters saw police using stun grenades.
Police also have faced criticism for firing the tear gas canisters directly at the crowd, rather than aiming away from the protesters and letting the wind carry the gas into the crowd—as is the general practice with riot police.
Protesters said their gathering was peaceful, but many used iron rods, slingshots, firecrackers and bottles to attack police. An AP Television News reporter saw at least three protesters carrying guns.
The protesters from the People's Alliance for Democracy say Prime Minister Somchai Wongsawat is a pawn of Thaksin, his brother-in-law. Thaksin has fled to London to escape an array of corruption charges.
Thaksin, a former telecommunications billionaire, was highly popular among Thailand's rural majority. The alliance wants sweeping changes to the country's election system to reduce the power of the rural poor, who it claims are susceptible to vote-buying by corrupt politicians.

Tomás Ojea Quintana, the UN special reporteur on human rights in Burma, outlined “core human rights elements” that should be put in place before the 2010 general election, in a statement released on Wednesday.
The elements include:
—Amend domestic laws that limit freedom of expression, opinion and peaceful assembly.
—Release of political prisoners.
—Repeal discriminatory laws.
—Stop the recruitment of child soldiers.
"Respect for international human rights standards is indispensable" for the regime's proposed "roadmap to democracy" to gain international acceptance, Quintana said.
He said full enjoyment of human rights does not exist in Burma, according to "reliable reports on the extension of detentions and/or new arrests of political activists."
The release of political prisoner would reduce tension and inspire political participation among stakeholders in Burma, he said.
The transition to a multi-party democratic and civil government, as planned under the new constitution, will require “an intensive process of incorporating democratic values,” Quintana said.
He suggested a number of changes in the country’s judiciary, which currently "is not independent and is under the direct control of the government and the military."
Proposed changes include guaranteeing the due process of law, establishing a fully independent and impartial judiciary and setting up a mechanism to investigate human rights abuses.
Quintana, who took up his post in May 2007, visited Burma in August and met with prominent political prisoners, including U Gambira, the head of the All-Burmese Monks Alliance, a leading force in the 2007 demonstrations. He met with Gambari in Insein Prison, where he was being held prior to standing trial for posing a threat to the security of the state.
Meanwhile, UN Secretary-General Ban Ki-moon said on Tuesday his planned visit to Burma in December might not take place unless he sees the regime is ready to produce tangible results toward progress in democratization.
Also, the UN High Commissioner for Human Rights, Navi Pillay, this week called for the release of all political prisoners including detained democracy leader Aung San Suu Kyi.
The junta now holds 2,123 political prisoners in various prisons across the country, according to a report compiled by the Thailand-based Assistance Association for Political Prisoners (Burma) and the US-based Campaign for Burma.
Two leading activist groups in a joint letter to UN Secretary-General Ban released on Sunday said, "Dramatic increases in the number of political prisoners show the junta's defiance of the United Nations and international community, as well as its own people."
