Min Ko Naing and Eight Members of the 88 Generation Students Sentenced
for Contempt of the Court
I have reported on Oct 27, 2008 that the judge from Rangoon Northern
District Court, held inside the Insein Prison Compound, told the
members of the 88 Generation Students on trials that they would be
charged with Section 188 of the Penal Code for contempt of the court.
Today, on Oct 29, 2008, during the court hearing, Min Ko Naing and all
defendants stood up and complained for their right and lack of free
and independent judiciary. Then Judge accused that they were
disturbing the court procedure, charged them with the Section 188 of
the Penal Code and delivered six-month imprisonment each for nine
student leaders, Min Ko Naing, Ko Ko Gyi, Mya Aye, Min Zeya, Pyone
Choe (aka) Htay Win Aung, Aung Thu, Hla Myo Naung, and Aung Naing. The
rest defendants stood up and demanded the judge to sentence them too.
Then, the judge ordered security forces to remove the defendants from
the court and adjourned the trial.

One More Charge for Min Ko Naing and 88 Generation Students Group

Min Ko Naing and 34 members of the 88 Generation Students are facing
21 trials with dozens of charges, which will lead up to over 150 years
imprisonment, since August 2008. Their cases were heard by two
District Courts and seven Township Courts, held inside the Insein
Prison Compound. Since October 15, 2008, all Township Courts handed
over the cases to three District Courts, which are Rangoon Eastern
District Court, Rangoon Western District Court and Rangoon Northern
District Court. These three District Courts are hearing the cases
inside Insein Prison Compound. As they are instructed to wrap up the
cases by the authorities, the court hearings are held at least two or
three days a week.
Last Friday, on Oct 24, 2008, Rangoon Northern District Court held a
hearing against Min Ko Naing and group. All student leaders stood up
and asked the judge to allow their family members to attend the
hearing. Security was very tight. Armed security forces were present
outside and inside the Insein Prison Compound and around the Special
Court. Further, dozens of armed police stood behind all defendants in
the Court room. When the student leaders stood up and demanded for
their rights, the police prosecutor asked the judge to take action
against the defendants for contempt of the court and the judge
instructed the armed police to force them down to sit. Later, the
judge decided to adjourn the hearing and instructed the police to
remove defendants from the court room. Before they left the room, the
judge told them that they would be charged with Section 188 of the
Penal Code, for contempt of the court.
Their trial continued on Monday, Oct 27. Many defendants began to
withdraw their attorney power from their lawyers, as they believe it
is not a fair trial. Some refused to answer the questions of the
prosecutors. Security was still tight and the defendants are concerned
for their safety. Trial will continue on Wednesday, Oct 29, 2008.

၈၈ေခါင္းေဆာင္ ကိုမင္းကုိႏုိင္ အပါအ၀င္ ၉ဦးကို တရားရံုးကုိ မထီမဲ့ျမင္ျပဳတဲ့ ပုဒ္မနဲ႔ တရားလုိ အရာရွိျဖစ္တဲ့ ဦးျမႀကိဳင္ကေန တရားစဲြဆုိခဲ့ၿပီး တရားရံုးကို တင္ျပရာမွာ တရားရံုးက ဒီေန႔မွာ ေထာင္ဒဏ္ ၆ လ အျပစ္ေပး လုိက္ပါတယ္။ ဒီအေၾကာင္းနဲ႔ ပတ္သက္ၿပီး ေက်ာင္းသားေတြရဲ႕ အမႈလုိက္ေရွ႕ေန ဦးေအာင္သိန္းက ၾကားသိရသမွ်ကို အခုလုိ ေျပာျပပါတယ္။
“မင္းကိုႏုိင္ရယ္၊ ကိုကိုႀကီးရယ္၊ လွမ်ိဳးေႏွာင္ရယ္၊ ျမေအးရယ္၊ ဥာဏ္လင္း၊ ၿပဳံးခ်ိဳ၊ ေအာင္သူ၊ ေဌးႂကြယ္၊ မ်ိဳးရန္ႏုိင္တုိ႔ ကိုးဦးကုိ အမႈကေန ဖယ္ထုတ္ၿပီးေတာ့ ေလွ်ာက္ထားတယ္။ သူတုိ႔ကုိ တရားရံုးကုိ မထီေလးစား ျပဳလုပ္တဲ့ ပုဒ္မ အေရးယူေပးဖုိ႔ ဆုိၿပီး ဦးျမႀကိဳင္က တရားရံုးကို ေလွ်ာက္ထားတယ္။ ၿပီးေတာ့ အဲဒီ အမႈကို တရားရံုးက အမိန္႔မခ်ေသးဘူး။ ခဏ ဆုိင္းထားဦးမယ္လုိ႔ ေျပာတယ္။ ပုဒ္မ ၂၂၈အရ တရားရံုးကို အေႏွာက္အယွက္ေပးတယ္။ တရားရံုးကို အမႈစစ္ေဆးရာမွာ ဟန္႔တား ေႏွာက္ယွက္မႈေတြ ျပဳတဲ့ အေရးယူေပးဖုိ႔ ေလွ်ာက္တယ္။ ဒီေန႔က်ေတာ့ သူတုိ႔ ၉ေယာက္ကို ရံုးထုတ္တယ္။ သူတုိ႔ကုိ ေထာင္ဒဏ္ ၆ လစီ ျပစ္ဒဏ္ေပးတယ္။”
ေက်ာင္းသားေခါင္းေဆာင္ေတြကို စဲြဆုိထားတဲ့ ထားတဲ့ ပုဒ္မေတြက အမ်ားႀကီးရွိေသးေပမယ့္ ဒီေန႔ စစ္တဲ့ အမႈထဲမွာေတာ့ အဲဒီ အမႈေတြ မပါလာပါဘူး။
