BURMA LEADER MARKS 13 YEARS OF IMPRISONMENT -- The first lady of Burmese politics, pro-democracy leader Aung San Suu Kyi, marked 13 years under house arrest on Oct. 25, as supporters around the world continued their calls for her release.

Australia's The Age called the date a prominent illustration of the "bitter tyranny" existing in Burma, noting that "the Lady's unjust imprisonment is a powerful reminder of a brief moment of freedom realized by Burma's people and the dream that remains unfulfilled."

The anniversary happened to coincide this year with the seventh Asia-Europe summit meeting, a major gathering of government representatives from over 40 countries, who used the occasion to issue a united call for the release of Suu Kyi as well as hundreds of other political prisoners in Burma. "This is a significant breakthrough," said Mark Farmaner, director of the Burma Campaign U.K., in a press release. "It is the first time we have had Europe and Asia come together in this way to demand real political progress in Burma."

The international community has been increasingly vocal towards Burma in recent weeks, as frustration over a lack of progress combines with the possibility of a December visit to to the country by U.N. Secretary-General Ban Ki-moon. Ban's envoy, Ibrahim Gambari, has made repeated trips to Burma in a bid to convince the ruling military junta to improve rights protections and to restore some measures of democracy. The release of Suu Kyi is viewed by many as the single most powerful statement the junta could make to prove its willingness to reform. Despite a few instances of lip service (see Brian McCartan's WPR briefing) and a much-maligned "system overhaul," the junta has shown little inclination to address the world community's concerns.

While Suu Kyi's long struggle to return democracy to Burma has won her admirers around the world and resulted in her selection for the 1991 Nobel Peace Prize, there has been persistent grumbling among younger Burmese that non-violent engagement has achieved little -- especially after the ruling junta's brutal crackdown on monk-led protests last year. It is a dilemma the Dalai Lama has also had to contend with in recent years as younger Tibetans increasingly consider negotiating with China futile. But whereas the Dalai Lama can directly engage and encourage his supporters to follow the path of non-violence, Suu Kyi is all but cut off from the world.

EUROPE HONORS CHINESE DISSIDENT -- Imprisoned Chinese human rights and democracy activist Hu Jia won this year's Sakharov Prize for Freedom of Thought on Oct. 23 in an obvious rebuke by European parliamentarians of China's rights record. The Sakharov prize is awarded by the European Parliament in honor of Andrei Sakharov, a Soviet physicist, pro-democracy leader and Nobel Peace Prize recipient. Past winners include former Kosovo Albanian leader Ibrahim Rugova, Burma's Aung San Suu Kyi, former U.N. chief Kofi Annan (along with the U.N. staff) and Nigerian human rights lawyer Hauwa Igrahim.

"Hu Jia is one of the real defenders of human rights in the People's Republic of China. The European Parliament is sending out a signal of clear support to all those who support human rights in China," Hans-Gert Pottering, president of the European Parliament, said of the decision.

Virtually unknown only a couple years ago, Hu Jia has since emerged as an internationally recognized rights advocate and become a significant thorn in Beijing's side as a result. Chinese authorities had Hu in their sights for some time, placing him under house arrest (along with his wife and infant daughter) throughout 2007, before arresting him in December 2007, one month after he'd highlighted connections between China's worsening rights situation and the Beijing Olympics in a video presentation to the European Parliament.

In April 2008, Chinese courts sentenced Hu to three-and-a-half years in prison for "inciting to subvert state power," setting off persistent international calls for his release.

Hu was repeatedly named as a likely winner of the 2008 Nobel Peace Prize but lost out to former Finnish president and career peacemaker, Martti Ahtisaari, disappointing many in the human rights community who were looking to the Nobel committee to send a strong message to Beijing.

ADVOCATES SEEK GREATER ATTENTION FOR MIGRANT WORKERS -- International human rights groups and U.N. Secretary-General Ban Ki-moon called for greater attention to migrant workers' rights last week, as reports of migrant worker-related incidents multiplied around the globe.

On Oct. 29, a migrant worker died at the hands of a half dozen assailants on a train in Mumbai, the latest in a string of deadly outbreaks of violence in India's northeast in recent weeks. Tensions between urban and rural dwellers have been steadily rising in recent years, as impoverished Bangladeshis from across the border and Indian villagers leave rural areas in droves hoping to cash in on the country's growth. Urbanites accuse the newcomers of taking away jobs, and radical Hindu politicians have been widely blamed for stoking the flames of violence.

Meanwhile in Jordan, Amnesty International called on lawmakers to pass legislation that would more strictly define employment terms for domestic migrant workers, setting standards for working hours, rest time and treatment of those facing abuse. Tens of thousands of migrant women -- many from East and Southeast Asia -- work in Jordan, with the majority facing some sort of emotional or physical abuse.

East and Southeast Asian governments also found themselves facing reprimands over their failure to protect migrant workers, a group particularly vulnerable to abuse, in a report released jointly (.pdf) on Oct. 23 by 16 United Nations and aid agencies. "Governments in the region are trying to manage the supply of and demand for migrant workers in a way that meets market needs and minimizes irregular migration. While progress is being made in this regard, opportunities for regular migration remain limited, and employer and migrants react by working outside the existing legal framework," the report said.

One of the greatest sources of potential abuse lies in the system of commercial trade in migrant workers, in which job hunters pay agencies to secure employment and provide transit. In many cases, workers are transported illegally or trapped into debt bondage with little recourse for help. The report also noted a rise in the number of female migrants in the area and urged countries to take additional steps to increase gender-sensitive protections.

NIGER CONVICTED IN SLAVERY CASE -- Anti-slavery activists the world round cheered last week's verdict by the Economic Community of West African States' (ECOWAS) Community Court of Justice finding Niger guilty of failing to protect a young girl from being sold into slavery.

Hadijatou Mani was sold into slavery at age 12 in 1996, after which she regularly suffered emotional, physical and sexual abuse. Her main tasks were related to housework, but Mani was also used as a "wahiya" (sex slave), producing three children for her master.

Mani, the child of a slave, faced the threat of stigma and discrimination for publicly challenging the system but considered it a risk worth taking to secure her family's future. "It was very difficult to challenge my former master and to speak out when people see you as nothing more than a slave. But I knew that this was the only way to protect my child from suffering the same fate as myself," she said.

Slavery remains a serious problem in many parts of Africa -- including Burkina Faso, Niger, Mali, Mauritania and the Sudan -- despite legislation prohibiting the practice, with tens of thousands of people languishing in circumstances beyond their control, doomed to watch their children's lives follow the same path. In Niger alone, rights activists believe that as many as 45,000 people are currently living as slaves with no rights and little protection, despite a 2003 law aimed at dismantling the tradition.

Activists hailed last week's ruling as a major victory for anti-slavery efforts, and expressed hope that the court's decision will set a precedent adopted by other judicial institutions.

Junta Invites Gambari to Visit Burma Again

UNITED NATIONS — Burma’s military junta has invited United Nations Special Envoy Ibrahim Gambari to visit the country either in the last week of November or early next month, according to UN sources.

The sources told The Irrawaddy that decision makers at the UN’s headquarters in New York have yet to make a call on whether to accept the invitation, as they want to make sure that Gambari’s next visit doesn’t end as abysmally as the last one in August.

During his August visit, Gambari met neither the country’s military ruler, Snr-Gen Than Shwe, nor the popular leader of the country’s pro-democracy movement, Aung San Suu Kyi, whose refusal to appear for talks with the envoy was seen as a sign that his efforts have lost the confidence of the opposition.

Critics also pointed to the regime’s refusal to make any concessions on the UN’s demands for political reform and the protection of human rights as evidence of Gambari’s faltering performance.

The invitation was extended to Gambari during a recent luncheon meeting with Kyaw Tint Swe, the Burmese regime’s ambassador to the UN. No fixed dates were set for the proposed visit.

Reliable sources said that Gambari’s trip, if it goes ahead, will be used by the UN to prepare for a visit to Burma by UN Secretary General Ban Ki-moon, who was initially scheduled to travel to the country in December.

A December visit by the UN chief looks unlikely, however, as the regime has given no indication that it will meet the world body’s demands for democratic change and the release of political prisoners.

Ban lasted visited Burma in May, several weeks after Cyclone Nargis devastated the Irrawaddy delta, to break a deadlock over the regime’s refusal to allow foreign aid workers into the country.

It is believed that Gambari and top UN decision makers are demanding that the junta make a firm commitment to achieving substantive progress before deciding on exact dates for his next visit.

UN officials believe that a repeat of the August debacle would be a major setback to the world body’s efforts in this Southeast Asian nation, which has been ruled by the military for nearly half a century.

Officials said that the Burmese junta and the UN are currently engaged in negotiations over various aspects of Gambari’s visit. Prominent among these are the list of leaders and officials Gambari would have access to during his trip, and assurances from the regime that it is willing to take new steps in the right direction.

ေဒၚေအာင္ဆန္းစုၾကည္၏ ေနအိမ္ၿခံ၀င္းထဲမွ အမႈိက္မ်ားကုိ ႏုိ္၀င္ဘာ (၁) ရက္ ေန႔လယ္ပုိင္း၌ စည္ပင္သာယာ၀န္ထမ္းမ်ား လာေရာက္ရွင္းလင္းေနသျဖင့္ ႏုိင္ငံေရးအရ တစုံတရာ အေၾကာင္းရွိမည္ထင္ၿပီး ရန္ကုန္ၿမိဳ႕တြင္ ေ၀ဖန္ခန္႔မွန္းေနၾကသည္။

မ်က္ျမင္သက္ေသမ်ား၏ ေျပာဆုိခ်က္အရ ႏုိ၀င္ဘာ (၁) ရက္ ေန႔လယ္ပုိင္း၌ ေဒၚေအာင္ဆန္းစုၾကည္၏ ၿခံတခါးပြင့္ေနသည့္အျပင္ စည္ပင္သာယာ၀န္ထမ္းမ်ား ၿခံထဲမွထြက္လာသည္ဟု သိရသည္။

မ်က္ျမင္သက္ေသတဦးက “က်ေနာ္တုိ႔ တကၠသုိလ္ထဲမွာ ဘြဲ ့ႏွင္းသဘင္အခမ္းအနားကုိတက္ဖုိ႔ အဲဒီတကၠသုိလ္ရိပ္သာလမ္းကေန ျဖတ္သြားတာပါ။ အဲဒီမွာ ျမင္ခဲ့ရတာက ေဒၚေအာင္ဆန္းစုၾကည္ရဲ႕ ၿခံတံခါးကပြင့္ေနၿပီး စည္ပင္ အမႈိက္သိမ္းကားက ၿခံေရွ႕မွာ ရပ္ထားတယ္။ ေနာက္စည္ပင္၀န္ထမ္းေတြက ၿခံထဲကေနထြက္လာတာကုိ ေတြ႕ရတယ္” ဟု ေျပာသည္။

ထုိျမင္ကြင္းေၾကာင့္ ကုလအတြင္းေရးမႉးခ်ဳပ္ ဘန္ကီမြန္းလာႏုိင္သည့္အတြက္ အာဏာပုိင္မ်ားက ေဒၚေအာင္ဆန္းစုၾကည္အိမ္ၿခံကုိ ေဆးသုတ္ ရွင္းလင္းေပေနသလား စသျဖင့္ ရန္ကုန္ၿမိဳ႕တြင္ ခန္႔မွန္းေ၀ဖန္ေျပာဆုိေနၾကသည္။

Six months after cyclone, Burmese junta tightens grip

Despite its uncaring response to the disaster that killed 150,000, the military is stronger than ever

Six months after a huge cyclone tore through Burma's Irrawaddy Delta, killing up to 150,000 people, thousands of people remain dependent on food aid. The disaster set the country's military junta one of its biggest challenges in more than four decades of oppressive rule, but, if anything, its grip has been strengthened.

The latest risk to the population of the Delta, the most densely populated area of the country, is a lack of drinking water. Immediately after the cyclone, most people relied on monsoon rain for safe water. But now the dry season is coming, and despite an enormous effort to clean up drinking water ponds, many are still unfit for consumption.

"The lack of clean water will directly impact the health of children," said Andrew Kirkwood, Save the Children's country director in Burma. "Scarce family resources will be further strained if they must purchase water, as will relationships among communities if they must compete for this resource."

The damage in May from Cyclone Nargis was huge. Entire villages were destroyed and thousands of people were swept out to sea. Crops and livestock were devastated in what was once Burma's breadbasket, and hundreds of thousands were left homeless – and reliant on a government that demonstrated little inclination or ability to help.

Initially suspicious of foreign offers of aid, the junta blocked entry to aid workers, supplies and helicopters. Eventually, the regime allowed aid workers access to certain parts of the Delta. That decision, it appears, saved thousands of lives.

"The situation is better than I had expected. A huge amount of support did get through," said Roger Yates of ActionAid, who visited the area last week. "The problem now is how to restore livelihoods and to build preparedness to deal with future storms."

Six months ago, the UN launched an appeal for $500m (£310m) to deal with the emergency. Little more than half of this has been committed, which means that long-term rehabilitation is suffering. "I went to villages and asked if anyone had had a good night's sleep since the storm, and they all said no," Mr Yates said. "They told me that every time there is a wind the children get scared. Everyone is on edge."

Burma, the poorest country in south-east Asia, has been ruled since 1962 by a succession of military regimes that have jailed opposition politicians such as Aung San Suu Kyi. Worldwide criticism of the junta after the cyclone led activists to believe its grip might be loosened, since the disaster came only months after massive public demonstrations in September 2007, when up to 100,000 Buddhist monks and others took to the streets in protest. But those protests were violently put down, and, six months after Nargis, the regime appears to have cemented its position.

"The cyclone has been a blessing for the regime," said Mark Farmaner, of the Burma Campaign UK. "The UN and governments seem to have forgotten the brutal suppression of the peaceful uprising last year. Forgotten also are the 2,100 political prisoners... The small amount of humanitarian space they have opened up in the Delta region is being hailed as a major breakthrough, despite aid restrictions still existing in the rest of the country."

Next month will see a return trip to Burma by the UN Secretary-General, Ban Ki-moon, who visited the Delta in May. Some hope this might persuade the regime to release some political prisoners. In May, just days after Nargis struck, the regime held a referendum for a new constitution that will purportedly open the way for multi-party elections in 2010. Most believe the referendum was a sham.

Six months after Cyclone Nargis slammed into army-ruled Burma, killing more than 130 000 people, many in the worst-hit Irrawaddy Delta continue to rely on handouts to stay alive.

"We get rice and beans from a charity called Care Burma, drinking water from the sky and fish from this creek," said Maung Oo, a swarthy 51-year-old, as he stared at monsoon floodwaters lapping against his makeshift bamboo and tarpaulin hut.

Around the village, 40km south of Rangoon, the paddy fields are under water and unplanted, casting doubt on assertions from the United Nations Food and Agriculture Organisation that 97% of storm-hit parts of the delta -- once the "rice bowl of Asia" -- is under cultivation again.

"We can't wait to grow our own paddy. We really hate living on charity -- although that is not to say we are not grateful," Maung Oo said.

"We don't want to depend on others, but to be honest, that's just wishful thinking at the moment because the situation does not allow us to be independent as yet," he said.

It may be another four weeks before he can start planting, he added.

The rough monsoon season weather in the delta in the last four months has also kept the villagers on edge, every storm stirring up fears of a repeat of the May 2 cyclone that crashed ashore with a 4m wall of water.

"We get scared to death when it's windy so we now keep a radio handy all the time so that we can know the size of the danger by listening to the weather report," his wife, Ma Nu, said, holding up a basic battery-powered wireless set.

Another farmer, 70-year-old Bo Sein, complained that rice seed handed out for replanting was a mixture of varieties that ripen at different times, making it a nightmare to harvest.

"Maybe it's because they came from different sources, but as a result while some plants are ready to harvest others are still not ripe," he said.

Homes for the favoured
Even though most of the estimated 2,4-million people affected by the cyclone have received little official assistance, a few new homes built by private donors under the aegis of the ruling military junta have sprung up from the devastation.

In some cases, however, they have gone to those with the best connections, rather than the most pressing needs.

"Not all the needy got houses and not all those who got houses were needy," said one resident of Latkhitegon, a village south of Rangoon that has received ten new wooden homes.

"Five of them had their homes really badly damaged by Nargis. The other five did not suffer that much damage, but they got the houses because they are the VIPs," the man, who did not wish to be name for fear of reprisals, said.

Thayet Thonebin, a village south of Rangoon where half the 340 residents were killed, have fared better in the rehabilitation lottery, receiving 32 new homes courtesy of the Energy Ministry and Malaysian petroleum company Petronas.

However, survivors are still haunted by a sense of shame at relying on handouts and hopelessness at a lack of jobs or prospects.

"We are really ashamed by having to live on the charity all the time. We now have to depend on them for rice," said labourer Maung Tun.

"ဒီ စစ္အာဏာရွင္ စနစ္ကို ဖယ္ခ်ျပီး ဒီမိုကေရစီ ႏိုင္ငံသစ္ တည္ေထာင္မယ့္ ေနရာမွာ ေႏွာင့္ေႏွးၾကန္႔ၾကာရင္ ျပည္သူေတြ နာတယ္။ လူထုနာတယ္။ တိုင္းျပည္နာတယ္။" ဟု ဦးသန္းျမင့္က ေျပာသည္။

ေအာက္တိုဘာလ ၁၆ ရက္ေန႔က ပါတီတြင္း လူငယ္ေခါင္းေဆာင္မ်ား ခန္႔အပ္ထားျခင္းႏွင့္ ပတ္သက္၍ အၾကီးတန္း ေခါင္းေဆာင္မ်ားႏွင့္ သေဘာကြဲျပီး ရန္ကုန္တိုင္းအတြင္းမွ လူငယ္ ၁၀၉ ေယာက္ ႏႈတ္ထြက္ခဲ့သည္။

Christians Face Growing Persecution in Burma

MAE SOT, THAILAND --- Saw Stephen, 34, an ethnic Karen, has been trying to serve as a pastor in the Karenni State of Burma since 1996. But like many Christians in Burma, Pastor Stephen faces persecution from the Burmese military junta, known as the State Peace and Development Council (SPDC).

“My first church, Shadow Baptist Church, which I pastured, had over 250 people, but the military government [of Burma] came and destroyed it. This happened in April 1999. The military burned down the houses of the people and came with axes and sticks and destroyed the church,” Pastor Stephen told Christian Freedom International.

“They captured me and took me to their military office. They put me under house arrest for four months in a small room. I could not contact my family,” said Pastor Stephen.

“After release from there I was reassigned to another church, Law Da Lay Baptist Church in Karenni State,” said Stephen. “We had over 120 families; more than 600 villagers attended the church. Most villagers were Christians.”

“On November 5, 2003, the military government came in to the village and ordered us to move. They said ‘if you do not move within one week you are our enemies.’ They didn’t explain why we have to move,” said Stephen. “The soldiers destroyed our church.”

Stephen told Christian Freedom International, “So now nobody stay in the village, everyone moved away. Most moved into the jungle. Then we came to the refugee camps in Thailand.”

According to Stephen, “The government [of Burma] will not allow us to rebuild the churches. They will not allow us to build any church in Burma.”

Stephen now lives life on the run: “So now I cannot stay very long in one area. So I go from place to place. It is not safe for me.”

“The Burmese government is anti-Christian,” said Stephen. “They are afraid that Christianity will bring in the Western ways to Burma. It will ruin the Burmese culture they say. They see Christianity as a Western religion. It is the main religion of the West, they say, which is why they hate it and are afraid of it. We have been told by the junta leaders that the people of Burma have to be careful about Christians; the Western policies can come in and overtake us, they say.”

Stephen told Christian Freedom International that starvation is rampant in Burma: “The people are starving in Burma. I see so many children starving to death. There are so many children dying; they have nothing to eat. They have no food. No one can change Burma. It must be God that changes Burma. Please pray for Burma.”

BANGKOK, Oct 31 (IPS) - The largest island off Burma’s west coast is emerging as another frontier for China’s expanding plans to extract the rich oil and gas reserves of military-ruled Burma.

Initial explorations by a consortium, led by China National Offshore Oil Company (CNOOC), has left a deep scar on Ramree Island, which is twice the size of Singapore and home to about 400,000 people. ‘’They have destroyed rice fields and plantations when conducting the seismic surveys and mining the island in search of oil,’’ says Jockai Khaing, director of Arakan Oil Watch (AOW), an environmental group made up of Burmese living in exile.

‘’The local communities have been directly and indirectly affected,’’ he Said during an IPS interview. ‘’Hundreds of people have been forced to relocate as a result of the drilling conducted near their communities. The locals hate the Chinese; their world has become crazy after the Chinese arrived.’’

CNOOC has been pushing ahead with its work since early 2005, with no attempt to consult the local residents and showing little regard to such notions as corporate social responsibility, adds Jockai. The Chinese company, which is listed on the New York and the Hong Kong stock exchanges, has ‘’not conducted the required environmental impact assessments and social impact assessments that are recognised internationally as a must before exploration work begins.’’

To dispose the waste from its drilling sites, ‘’CNOOC workers dug shallow canals designed to carry the (toxic) ‘drilling mud,’ or wastewater containing oil, away from the drilling sites and into Chaing Wa Creek, which curves past several local farms before flowing into the Bay of Bengal,’’ states a report by AOW, released in mid-October. ‘’This arbitrary disposal can make soil in surrounding areas unsuitable for plant growth by reducing the availability of nutrients or by increasing toxic contents in the soil.’’

Concerns about the cost of letting China tighten its grip on the natural resources in Burma (or Myanmar) has also been expressed by other groups, like EarthRights International (EI), a U.S.-based group championing human rights. There are 69 Chinese companies involved in 90 ‘’completed, current and planned projects’’ in the oil, gas and hydropower sectors in Burma, EI revealed in groundbreaking report released in late September.

That number marks an over 200 percent increase in the number of Chinese energy developers thought to have had existed a year before. ‘’Given what we know about development projects in Burma and the current situation, we’re concerned about this marked increase in the number of the projects,’’ the rights lobby stated in the report, ‘China in Burma: The Increasing Involvement of Chinese Multinational Corporations in Burma’s Hydropower, Oil and Natural Gas, and Mining Sectors.

‘’China is using Burma’s military dictatorship to its advantage as it goes in search of oil and gas. There are no rules and regulations for Chinese companies to follow in Burma,’’ Ka Hsaw Wa, executive director of EI, said in an IPS interview. ‘’This will hurt the future of Burma.’’

Such criticisms come at a time when China has begun to show signs that the environment cost of its projects abroad cannot be ignored. ‘’The country lacked comprehensive environmental protection policies in its overseas projects, although investment had been expanding,’’ states a report released in mid-September by the Chinese Academy for Environmental Planning (CAEP), according to the ‘China Daily’ newspaper.

‘’China’s overseas investment and aid mainly focuses on exploring oil and other resources, processing and manufacturing, and construction in African and Southeast Asian countries,’’ the English-language daily added. ‘’Without proper management, such projects are likely to cause environmental problems, the (CAEP) report said.’’

Burma, in fact, will prove to be an ideal testing ground, given that China emerged as the military-ruled country’s biggest investor in the country’s power sector. The money flowing in from such foreign direct investments and the sale of gas has helped to prop up a junta notorious for suppressing its people through many forms of abuse.

In 2006, the junta earned an estimated 2.16 billion U.S. dollars from sales of natural gas to Thailand, which accounts for close to half of Burma’s export earnings and is the single largest source of foreign earnings. In 2008, Burma is expected to earn 3.5 billion US dollars from export of gas, according to one estimate.

But little of these benefits trickled down to the country’s beleaguered people. Consequently, Burma ranks as one of the world’s least developed countries. And having an abundance of natural resources has not improved the power supply in the country for the people either. Regular blackouts are frequent in Rangoon, the former capital, and elsewhere.

The junta has profited in other ways, too, from China’s energy interest in Burma. ‘’Beijing has come to the junta’s rescue and protects it from criticism at international forums like the U.N. Security Council,’’ says Win Min, a Burmese national security expert teaching at a university in northern Thailand. ‘’A strong relationship of mutual benefit has developed since 1988.’’

In exchange for letting Chinese companies exploit its natural resources, the Burmese dictatorship has got military hardware from Beijing. They range from fighter jets and armoured carriers to small weapons, Win Min told IPS. ‘’The junta will open the country to China because the military regime needs Beijing more than the other way around.’’

November 2nd is the bi-annual anniversary of cyclone Nargis which struck Burma on 2 May and left more than 140,000 people dead or missing.

The military government arrested at least 20 volunteers after they helped cyclone victims. On 4th June, U Thura alias Zargana, a well-known comedian, became the first volunteer to be arrested by the authorities. 6 weeks after the disaster, Dr. Nay Win (Ne Win), Ma Hnin Pwint Wai, his daughter, U Aung Kyaw San, Ko Lin Htet Naing and Ko Hein Yaza Tun were arrested in Pya Pon Township, in the Irrawaddy delta. Their activities were not causing any harm to local people or the authorities. They just collected and buried the bodies of cyclone victims. On 1st October, U Ohn Kyaing was arrested. He is the chairperson of the Cyclone Relief Committee, National League for Democracy. He is now reportedly under investigation whilst in prison, accused of using funds collected to help victims of Cyclone Nargis to plan acts of terrorism.

Since 1988 to date, 137 political prisoners have died in prison. Many political prisoners are in poor health. Prison conditions are harsh and detainees are often denied vital medical treatment.

Recently, a monk escaped from a labor camp. His name is U Pyinyarthiri. He was imprisoned for three years after the peaceful demonstrations in September 2007. He was sent to Lend Tlann prison camp in Tiddim Township, Chin State. After three and half months in the camp, he decided to escape because of the harsh conditions.

He is currently in Mizoram State of India. In an interview with Mizzima News Agency, he talked about the torture he endured under interrogation. He said, “They kicked my chest with their combat boots and stomped on my face with my hands handcuffed behind me. Every question was accompanied by kicks and punches to my head and body. I was almost unconscious. I fell on the table in front of me when they kicked me from the back. At last I could not endure anymore such torture. They twisted my arms and tried to break them, which affected the nervous system in my hand. They pressed between my rib bones. They slapped me on my temple and pulled my earlobes violently. They stepped on my shins which left me with severe pain until I was sentenced to prison term. I could not walk well.”

Monks are highly revered in Burma, yet they are currently facing torture and ill-treatment in prisons. Cyclone volunteers and activists also face difficult and dangerous conditions in prison.

“Recently, some political prisoners have been forced to confess that they are responsible for planting bombs. In the past, the authorities blamed bomb attacks on armed groups. Now, they are pointing the finger at politicians like U Ohn Kyaing,” said Ko Tate Naing, secretary of the Assistance Association for Political Prisoners (Burma).

“The authorities are doing whatever they can to ensure long imprisonments for human rights activists and volunteers who worked to help cyclone victims,” continued Ko Tate Naing. We want to urge the authorities to stop this persecution and release these activists immediately and unconditionally. We also call on the United Nations and the international community to take concrete action to secure their freedom.”

Min Ko Naing Transferred ၈၈ေခါင္းေဆာင္မ်ားကို မအူပင္ေထာင္သို႔ ေျပာင္းေရႊ႕

Former student leader Min Ko Naing and eight leading political activists from the 88 Generation Students group were transferred on Friday morning from Rangoon’s Insein Prison to Maubin Prison in Irrawaddy Division two days after they were sentenced to six months imprisonment for disrespecting the court, according to sources inside Insein Prison.

A staff member at Insein told that Min Ko Naing and eight political prisoners were loaded into a prison truck, which left the prison at about 7am escorted by two police vehicles.

The nine members of the 88 Generation Students group were sentenced to six months imprisonment on Wednesday under Section 228 of the penal code—for contempt of court—by the Northern District Court inside Insein Prison in the northwestern suburbs of Rangoon.

According to the source, the nine political prisoners were named as Min Ko Naing, Ko Ko Gyi, Pyone Cho (aka Htay Win Aung), Htay Kywe, Mya Aye, Hla Myo Naung, Nyan Lin, Aung Thu and Myo Aung Naing.

Several members of the 88 Generation Students group were arrested, including Min Ko Naing, Ko Ko Gyi and Pyone Cho, after they led a march on August 19, 2007, against sharp increases in the price of fuel and other commodities, which led to mass demonstrations led by Buddhist monks the following month.

Since August 2008, more than 35 members of the 88 Generation Students group have been charged by the Insein Prison Special Court under a variety of charges, including Section 4 of the SPDC Law No. 5/96 (Endangering the National Convention).

The joint-secretary of Thailand-based Assistance Association for Political Prisoners (AAPP-Burma), Bo Kyi, said that the nine members of the 88 Generation Students group were moved to Maubin Prison because they verbally appealed to the judge for “free and fair justice.”

“They will not get regular family visits in Maubin,” Bo Kyi said. “The prison transfer will cause trouble for the prisoners’ health, their families and their lawyers.”

According to the AAPP-Burma, a political prisoner, Kyaw Myo Thant, died in Maubin Prison in 1990 under what it called “awful” conditions.

ယခုလ ၂၉ ရက္ေန႔က အင္းစိန္ေထာင္တြင္းရွိ ရန္ကုန္ ေျမာက္ပိုင္းခ႐ိုင္တရား႐ံုးတြင္ အမႈၾကားနာေနစဥ္ ေက်ာင္းသားေခါင္းေဆာင္ ၉ ဦးက တရားစီရင္မႈအား လြတ္လပ္မႈမရွိေၾကာင္း ေ၀ဖန္ေျပာဆိုသျဖင့္ ႐ံုးေတာ္အား မထီမဲ့ျမင္ျပဳမႈ - ရာဇသတ္ႀကီးပုဒ္မ ၂၂၈ ျဖင့္ ေထာင္ဒဏ္ ၆ လစီ ျပစ္ဒဏ္ခ်မွတ္ၿပီး ၂ ရက္အၾကာတြင္ ေထာင္ေျပာင္းေရႊ႕မႈ ေပၚေပါက္လာျခင္း ျဖစ္သည္။

Gem traders to fight Burma ban

The world's gemstone traders have decided to fight back against a new US law banning the sale of Burmese rubies and sapphires.

The new law, which came into effect this week, makes it illegal for American gem dealers to buy Burmese products - even if the stones have been cut, polished and re-traded from a third country.

Previously the law banned gems bought directly from Burma but not those traded via other countries.

Dave Mathieson from Human Rights Watch told Radio Australia that closing the legal loophole was a small but important step.

"In terms of monetary value it's probably not huge, but in terms of symbolic value and the fact that these counter-measures are in place and being tightened up, it is important because it sends a signal to the Burmese military government and their business associates that abusive production of gems and other precious metals won't be accepted into the United States," he said.

But the International Coloured Gemstone Association, which represents 600 traders in 40 countries, describes the law as "well-meaning" but "misguided".

"The huge concern I have and many other people in the industry [have] is that this was targeted to help the people of Burma and in fact there was little or no collateral damage study undertaken and they've actually forgotten about the very people they were trying to help," said Andrew Cody, the association's president.

The production of opium poppies in Burma has decreased over the last decade, but some farmers are choosing to go back to the lucrative drug trade.

However, Dave Mathieson from Human Rights Watch disagrees with the gem traders' argument - that those at the bottom of the industry will be hardest hit.

"That's really not the case, because a lot of the miners around Mogok and other places inside Burma get paid appallingly anyway, so they never see any of the top end profits of the trade," he said.

"And the small traders, the ones that actually do mine and bring some of the stones out, those guys don't actually make that much money and these measures don't affect their low level sales."

Since the 1960s, Burma has held annual gem sales and at the trade fair earlier this month, more two thousand dealers spent an estimated $US175 million on Burmese gems.

Human rights groups say this money funds Burma's repressive military, but Andrew Cody says only around 5 per cent of the profits from gemstones filters back to the Burmese regime.
